Switch to SPECT after being fragged then switch back again to play. Cheat?

Several cheats on pubs switch to spectator mode after being fragged then they switch back to play as normal to avoid having to honor the mandatory 5 seconds to re-spawn.
It's annoying and a lame cheat.
Is this an allowed and fair "feature" of the game or what?
