From a technical point of view - yes. In the same way as providers of other smartphones with an own marketplace can do too.
From a legally point of view it is highly doubtful that they would do it. Read this. This is not a general permission for jailbreaking in any country; but this means that it isn't prohibited in general anymore.
To lure as much ppl as possible to this app it makes sense if the port is available in the appstore. If you see here it is possible to port a cube game to iPhone:
